Land Use Development Application
Project Title: Murphy Flats High Density Housing Overlay (HDHO) rezone application to amend the development agreement for parcel no.’s 02-008-0094 & 02-008-0097, for the purpose of extending Murphy Flats phase II final plat approval deadline for six months and to allow for a local business or non-profit to hold title to HDHO units if the owner qualifies as an Actively Employed Household, per section 4.7.3(A)(2) of Grand County Land Use Code (LUC).

Project Description: The Murphy Flats HDHO district was approved by Ord. 600.01 on November 19, 2019 with accompanying Development Agreement for the above parcels. Per Grand County LUC section 4.7.8(F), the HDHO District approval shall automatically expire and be void unless the County approves and developer records a site plan or final plat for the HDHO development in accordance with Sections 4.7.9 and 9.5 within 24 months of the date of HDHO District approval. Per LUC section 4.7.8(D), once approved, the development agreement and master plan may not be amended or modified without reapplication to the County.
The HDHO district approval for Murphy Flats will expire on November 19, 2021, and final plat approval for Phase II is likely not to occur prior to that date. Citing several reasons for the delay in obtaining approval for the Final Plat, the applicant has formally requested a six-month extension for Phase II Final Plat for the project. The applicant also requests the Development Agreement be amended to include the allowance of local businesses or non-profits to hold title to HDHO units if they qualify as an Actively Employed Household per section 4.7.3(A)(2) of Grand County Land Use Code.
